Platinum Discount Card is a digital product, built on blockchain technology, integrated into Starplan's APS digital platform system (https://assetpointsuite.com/). Introduction to the Starplan Platinum Discount Card Terms and Conditions has established rules that are designed to minimize risks and provide a common, convenient, secure, and reliable global experience while supporting geography-specific rules that allow for variations and unique marketplace needs. They are set and modified by Starplan to support the use and advancement of Starplan products and services, and represent a binding contract between Starplan and each Cardholder. The Starplan Platinum Discount Card Terms and Conditions contain fundamental rules that apply to Platinum Discount Card system Cardholders and specify the minimum requirements applicable to all Cardholders to uphold the safety, security, soundness, integrity, and interoperability of the Starplan system. The Starplan Product and Service Rules also include operational requirements related to the Starplan Platinum Discount Card Terms and Conditions.
All Cardholders of PLATINUM DISCOUNT CARD are subject to and bound by the Starplan Charter Documents and the Starplan Rules, as applicable based on the nature of their participation and geography. In the event of any conflicts between the Starplan Charter Documents and the Starplan Rules, conflicts will be resolved in the following order of precedence: - Starplan Charter Documents - Starplan PLATINUM DISCOUNT CARD Terms and Conditions - Starplan Product and Service Rules - Starplan Supplemental Requirements Any use of or participation in any Starplan services or products not covered in the Starplan Rules will be governed by applicable participation agreements and associated documentation. Regardless of whether this document or other documents refer to these requirements as the Starplan International Operating Regulations or by other prior naming conventions, such references are deemed to refer to and incorporate the Starplan Rules.
Each Cardholders must comply with all applicable laws, regulations, and other legal requirements including, but not limited to, laws and regulations regarding electronic signature, consumer protection, and trademarks and copyright for each country in which the Cardholders operates. Each Cardholders is also responsible for ensuring that it’s comply with all applicable laws, regulations, and other legal requirements applicable to each country in which operate. Each Cardholders is encouraged to consult with its own legal counsel to ensure that it is in full compliance with all applicable laws, regulations, and other legal requirements in each country in which the Cardholders operates. In the event of any conflict between the Starplan Rules and any applicable laws or regulations, the requirements of the laws or regulations govern.
1. The PLATINUM Discount Card is issued exclusively by Starplan as a gift to all members of the Starplan crowdfunding campaign. 2. The PLATINUM Discount Card is strictly personal and may not be transferred to third parties for exploitation. 3. The PLATINUM Discount Card is not physically released to the holder, but is registered in the form of an NFT CARD (WEB 3.0) where all the owner's identity and usage data are encrypted and stored on block chain. 4. The PLATINUM Discount Card remains the property of the Starplan. The Cardholder is responsible for keeping his/her PLATINUM Discount Card and its Personal Identification Number (PIN) confidential and safe. The Cardholder shall not transfer or give the PLATINUM Discount Card and/or its PIN to other persons. The Cardholder shall keep the PLATINUM Discount Card secure at all times and the PLATINUM Discount Card information confidential from other persons. If the Cardholder violates this agreement and it is found that the PLATINUM Discount Card has been used, the Cardholder agrees to be wholly responsible for any use of the PLATINUM Discount Card. 5. Starplan reserves the right to unilaterally modify or renew these terms and conditions. Undertakes the obligation to inform the Holders card for any modifications as well as for any change, through the website of e-commerce Starplan. 6. Starplan reserves the exclusive right to terminate the use of the PLATINUM Discount Card to its services and / or to discontinue the distribution of its content to users / members who believe that they have violated these terms of use. 7. Starplan recognizes the importance of the issue of the security of your personal data as well as your electronic transactions and takes all the necessary measures, with the most modern and advanced methods, to ensure your maximum possible security. All information, which is related to your personal information and your transactions, is secure and confidential. The discount card is valid for only five (5) year from the start date 8. Each card has a unique number corresponding only to one owner (App ID E-CV) 9. Holders of PLATINUM Discount Card to enjoy its benefits and privileges, must show the membership discount card together with his PLATINUM Discount Card, before purchasing and upon payment of the bill of any product from the business 10. Every Holders of PLATINUM Discount Card enjoys the exclusive 70% discount on all products purchased on the Starplan e-commerce 11. Discounts and offers to card members do not work cumulatively with any other store offer. Holders of PLATINUM Discount Card are fruitful the discounts that are listed on the discount card and are not entitled to request a further offer 12. Discounts refer to actual product prices and do apply to products and services already on sale or offer from the e-commerce Starplan 13. For anything that occurs that is not referred to in the above terms, the Holders of PLATINUM Discount Card is only responsible for using the Card, and automatically and irrevocably accepts all of the above terms
Starplan will not disclose to any third party any confidential information, other than for any of the following: - Disclosure in the ordinary course of business to provide services of digital identity to a Cardholders - Disclosure with the consent of the Cardholders - Disclosure of data that is aggregated so as not to disclose the data of any single Cardholders - Other disclosure that is in accordance with applicable laws or regulations
A Cardholder in the Starplan APS system must recognize Starplan’s right, title, and interest in and to and ownership of Starplan technology, products, and services (including the intellectual property embodied within, including the Starplan name, Starplan Marks, and Starplan technology), and agree to protect these ownership rights and the integrity of the Marks by complying with the applicable Starplan Rules in all activities, including issuing, acquiring, and processing. No intellectual property rights are or shall be considered assigned by Starplan to a Cardholders under the Starplan Rules. A Cardholders or any other party does not have any property or other right, claim, or interest, including any patent right, trade secret right, or copyright interest, in PLATINUM Discount Card, or in any systems, processes, equipment, software, data, or materials that Starplan or its subsidiaries use with PLATINUM Discount Card, except Cardholders-supplied data.
Use of a Starplan service or Starplan product is at the discretion of Starplan, which may limit or impose conditions on its use, and may discontinue the service or product at any time.
A Cardholders must respond to and provide information requested by Starplan for a Starplan Rules violation that is under investigation. The Cardholders must submit its response and information, within the time period specified, by mail, courier, facsimile, hand, email, or other electronic delivery method. The Notification response is effective when posted, sent, or transmitted by the Cardholders to Starplan.
Each Cardholders is solely responsible for use in compliance with the Starplan Charter Documents and the Starplan PLATINUM DISCOUNT CARD Terms and Conditions and Starplan Product and Service Rules, and ensuring that its Starplan programs comply with all applicable legal and regulatory requirements. Each Cardholders shall Indemnify Starplan for and against Claims and Liabilities arising out for incorrect and/or fraudulent use of the PLATINUM DISCOUNT CARD.
- The Cardholder can cancel the PLATINUM DISCOUNT CARD at any time with written notification to the Starplan. - Starplan reserves its right to terminate, reject and stop the use of the PLATINUM DISCOUNT CARD under the following conditions: i. PLATINUM DISCOUNT CARD has expired ii. Cardholder dies iii. Cardholder has made or used fake documents to apply for the PLATINUM DISCOUNT CARD or other services related to the use of the PLATINUM DISCOUNT CARD or to circumvent criteria of the Cardholder’s qualifications per related laws or regulations, or has committed an action that can be interpreted as being fraudulent towards the Starplan or the general public, or has engaged in behavior that can be seen as contrary to laws/public order/good morals. iv. Cardholder is in breach of one of any Terms and Conditions herein. v. Cardholder prepares or use fake documents to apply for the Card, or there is reason to believe that he/she committed a fraudulent act. vi. Starplan discovers that information as stated in the application or other documents of the Cardholder is inaccurate, incomplete, or untrue.
